By accessing or using the Label Shark website and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Label Shark provides an online platform that allows users to compare available shipping options, purchase shipping labels, and access shipment-related services such as tracking and, where available, insurance.

Label Shark is a technology platform. We do not ourselves transport, carry, deliver, or physically handle packages. Shipping services are performed by third-party carriers and service providers.

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. By using Label Shark, you represent and warrant that you meet these requirements.

You agree to use the Service only for lawful purposes and in compliance with these Terms, all applicable laws and regulations, and all carrier rules and requirements.

You are solely responsible for all information submitted through the Service, including sender and recipient names, addresses, package dimensions, package weight, package contents, declared value, and any other shipment details.

You agree that all shipment information you provide is accurate, complete, and truthful. If you provide inaccurate or incomplete information, including incorrect package dimensions or weight, you may be subject to rate adjustments, surcharges, delivery delays, label invalidation, carrier penalties, or cancellation of service.

You are the shipper of record for any shipment you submit through the Service unless explicitly stated otherwise.

You may not use the Service to ship any item that is unlawful, prohibited, restricted, dangerous, or otherwise not accepted by the applicable carrier or by law.

Prohibited or restricted items may include, without limitation:

• Illegal goods or stolen property
• Hazardous materials, explosives, or flammable substances
• Firearms, ammunition, and regulated weapons where prohibited
• Counterfeit goods or infringing materials
• Live animals, human remains, or biological materials
• Items requiring special permits, declarations, or handling that you have not properly completed
• Any other items prohibited by applicable law or carrier rules

We reserve the right to refuse, cancel, suspend, or report any shipment that we believe violates these Terms, carrier policies, or applicable law.

By purchasing or using a shipping label through the Service, you also agree to the applicable terms, conditions, rules, and shipping policies of the selected carrier and any other relevant third-party service providers.

Carrier services, delivery times, delivery dates, scans, tracking events, insurance availability, and related services are controlled by the carrier or relevant third party, not by Label Shark.

Prices displayed on Label Shark may include carrier charges, service fees, platform fees, and markups. By purchasing a label, you agree to pay the total amount displayed at checkout.

Payment is processed through third-party payment processors. By submitting payment information, you authorize us and our payment providers to charge the applicable amount to your selected payment method.

Quoted prices are based on the shipment information you provide. If the actual shipment differs from the information submitted, including differences in weight, dimensions, packaging, destination, or service eligibility, additional charges or adjustments may apply.

Once payment is successfully completed, a shipping label may be made available to you for download or use. You are responsible for reviewing the label details before using it and for properly printing, attaching, and using the label in accordance with carrier requirements.

Risk of loss, delay, misdelivery, damage, seizure, disposal, or return remains with the shipper and the carrier, subject to applicable law and carrier terms.

Refunds, voids, or cancellations may be available only in limited circumstances and are subject to carrier rules, payment processor rules, fraud review, and our internal review procedures.

A label that has been used, scanned, manifested, or otherwise accepted by a carrier may not be eligible for a refund. Even unused labels may not always be refundable.

Where a refund is approved, it may be reduced by non-refundable third-party charges, payment processing costs, administrative costs, or other amounts we are permitted to retain under applicable law.

We may monitor transactions and shipment activity for fraud, abuse, sanctions compliance, identity verification, or other risk-related purposes.

We may request additional information, documentation, or identity verification at any time. We may delay, suspend, refuse, or cancel access to the Service or any shipment if we believe additional review is necessary.

You agree not to:

• Use the Service for unlawful, fraudulent, deceptive, or abusive purposes
• Provide false, misleading, or incomplete shipment information
• Attempt to evade pricing, security, verification, or fraud controls
• Interfere with the Service or access it using bots, scripts, or unauthorized automation
• Reverse engineer, scrape, copy, or misuse the Service or its data
• Use the Service in a manner that violates carrier terms or applicable law

We do not guarantee that the Service will always be available, uninterrupted, error-free, or suitable for any particular purpose.

We do not guarantee any quoted rate, delivery estimate, transit time, tracking event, pickup availability, or delivery outcome.

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

To the maximum extent permitted by law, Label Shark and its affiliates, owners, directors, officers, employees, contractors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of revenue, profit, business, goodwill, data, or shipments, arising out of or related to your use of the Service.

To the maximum extent permitted by law, our total liability arising out of or relating to any claim shall not exceed the amount you paid to Label Shark for the specific label or transaction giving rise to the claim.

You agree to defend, indemnify, and hold harmless Label Shark and its affiliates, owners, directors, officers, employees, contractors, and service providers from and against any claims, liabilities, damages, losses, fines, penalties, costs, and expenses, including reasonable legal fees, arising out of or related to:

• Your shipments or package contents
• Your use of the Service
• Your violation of these Terms
• Your violation of carrier rules or applicable law
• Any inaccurate or misleading information you submit

All content, software, branding, text, graphics, layout, and other materials on the Label Shark website are owned by Label Shark or its licensors and are protected by applicable intellectual property laws.

Carrier names, logos, and trademarks remain the property of their respective owners and are used for identification purposes only.

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, created risk for us or others, or used the Service in an improper manner.

We may update these Terms from time to time. Updated Terms become effective when posted on this page unless stated otherwise. Continued use of the Service after updated Terms are posted constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction of Label Shark's operating entity, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved in the courts having jurisdiction over Label Shark's operating entity, unless applicable law requires otherwise.
